Title issues that could derail your real estate purchase

When you purchase real estate in Connecticut, the owner will transfer the title to your name. Before this can happen, though, you need to hire someone to investigate the title and make sure no one other than the seller has a claim to the land you want to purchase. Per Discover.com, here are a few reasons why an individual or entity may have a claim to the title:

  • Taxes: It could be that the owner has not paid state or federal taxes and the government has put a lien on his or her property. In order to sell the land with a clear title, the owner must pay all taxes before closing.
  • Mechanic’s lien: Perhaps one of the selling points for you was the completely upgraded kitchen. However, the owner did not pay the contractor for the work done. In order to receive payment for the work, the contractor may file a mechanic’s lien against the property.
  • Another owner: Many people receive property in an inheritance. If the owner has a sibling who also received an interest in the house in the will, that co-owner must also sign the closing documents before the title can be transferred to you.
  • Mistake on the deed: People make mistakes, and if one of these is a typo or wrong word on the deed, it can cause serious trouble to the chain of title down the road. It is important to have the deed inspected carefully to ensure that every detail is correct.
